Terms of Service

1. Agreement
By creating an account or using Case360 (“Service”) you agree to these Terms of Service (“Terms”). If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.
2. Service description
Case360 is a cloud-based workplace investigation case management platform. We provide tools to organise cases, manage documents, assign tasks, and generate reports. The Service is provided on a subscription basis.
3. Accounts and access
- You are responsible for maintaining the security of your account credentials.
- Each organisation receives an isolated subdomain and data environment.
- You may not share credentials or allow access by unauthorised individuals.
- You must promptly notify us of any suspected unauthorised access.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Australian law.
- Attempt to access another organisation’s data.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Upload malicious code, malware, or files designed to harm our systems or users.
- Use the Service to store or process information that you do not have the right to use.
5. Data ownership
You retain full ownership of all data you upload or create within the Service (“Customer Data”). We do not claim any intellectual property rights over Customer Data. We process Customer Data only as necessary to provide the Service and as described in our Privacy Policy.
6. Subscription and billing
- Subscriptions are billed monthly in AUD, inclusive of GST.
- Trial periods are 14 days on the Professional plan. No credit card is required during the trial.
- Subscriptions automatically renew unless cancelled before the renewal date.
- We do not provide refunds for partial billing periods.
- If payment fails, we will retry for 7 days before suspending the account.
7. Service levels and availability
We target 99.5% monthly uptime. Scheduled maintenance will be communicated at least 24 hours in advance. We are not liable for downtime caused by third-party infrastructure providers or events outside our reasonable control.
8. Data security and residency
We store all Customer Data in Australia (Sydney region). We implement industry-standard security measures including encryption in transit and at rest, access controls, and regular security reviews. See our Privacy Policy for full details.
9. Confidentiality
Each party agrees to keep confidential information received from the other party confidential and not to disclose it to third parties without prior written consent, except as required by law.
10. Termination
- You may cancel your subscription at any time from the Billing page. Cancellation takes effect at the end of the current billing period.
- We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.
- Upon termination, your data is retained for 30 days then permanently deleted.
11. Limitation of liability
To the maximum extent permitted by Australian Consumer Law, our total liability for any claim arising from the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded by contract.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
